The Federal Motor Carrier Safety Administration (FMCSA) recently updated its Compliance, Safety, Accountability (CSA) methodology for its Safety Measurement System (SMS) to reflect the new 30-minute break requirement.
According to the severity weight table for the Hours-of-Service Compliance BASIC, the new violation, §395.3(a)(3)(ii) - Driving beyond 8 hour limit since the end of the last off duty or sleeper period of at least 30 minutes, is weighted at 7 and is scored against both the carrier and driver under CSA.
